These Terms of Use ("Terms") constitute legally binding terms and apply to each user of the Service, including registered and unregistered users (collectively "You"). We may modify these Terms at any time without notice by posting revised Terms on our website, and Your continued use of this website indicates acceptance of them, including any revisions that we make. If You do not agree to these Terms or to our Privacy Policy, please do not use this website or Service.

1) Betterfly.com will send you a welcome email when you register for our site and may periodically send you administrative emails. If you do not wish to receive occasional administrative emails, simply follow the instructions contained in these emails to unsubscribe.

2) You must be at least thirteen (13) years of age to use the website, and eighteen (18) years of age to register as a member of Betterfly.com. By registering for the website, you represent and warrant that you are at least 18 years of age.

3) A "Betterist" is a person on Betterfly.com who can help you be better at something; a "Member" is a person on Betterfly.com who wants to be better at something. On our website, while You may register as both a Betterist and a Member, You may not register more than once for either classification.

4) By using Betterfly.com, you agree not to use any robot, scraper, or other automatic electronic device, process, or means to access our website without explicit written permission from Bebetter LLC.

5) Additionally, you agree that you will not take any action that imposes an unreasonably large load on our infrastructure, or make any attempt to interfere with the proper working of our website and Services.

Content Rules and Information

By entering the Betterfly.com Win an iPod touch contest ("Contest") and accepting the terms herein, you agree to be bound by the following rules ("Rules"). These Rules apply only to this contest and not to any other contest sponsored by Bebetter LLC. Terms are subject to change.

1) How to Enter: NO PURCHASE OR CONTRIBUTION NECESSARY TO WIN. To enter, register at betterfly.com by filling out the on-line registration form and clicking "Register". Entries must be received between August 3, 2009 and Oct 31st, 2009. One Betterist entry and one Member entry will be considered for selection in the Contest, and duplicate entries as either a Betterist or a Member will be removed from consideration. Entries generated by macro, script or other automated means will be disqualified.

2) Eligibility: NO PURCHASE OR CONTRIBUTION NECESSARY TO WIN. Entrants must be a lawful permanent resident of the United States and be at least 18 years of age as of your date of entry. Contest void in Puerto Rico, U.S. Territories and possessions, outside of the U.S., and where prohibited by law.

3) Prize: One (1) contest winner ("Winner") will receive the following prize: One (1) $229.00 Apple Giftcard redeemable for an Apple iPod touch 8GB Digital Player. No transfer, substitution, or cash equivalent for prizes. Winner agrees to consult the manufacturer for any warranties on the equipment awarded.

4) Drawing and Notification: Winner will be determined in a random drawing on or about October 31, 2009 (from among all eligible entries) conducted by representatives of Bebetter LLC, whose decisions are final and binding in all matters relating to this contest. Winner will be notified by email on or about October 31, 2009 and will be given instructions on how to claim prize. If Winner fails to respond to notification within seven (7) business days of issuance, the potential Winner will be disqualified and forfeit his/her right to the prize, and an alternate Winner will be selected. Bebetter LLC is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify potential Winner. Bebetter LLC reserves the right to disqualify any Winner who misrepresents his/her personal information and/or violates any of these Rules. Odds of winning depend on the number of eligible entries received.

5) Release of Liability: By entering, you release Bebetter LLC from any and against any and all injury, loss or damage caused by your entrance into the Contest, and/or the use and/or misuse of the prize. Any attempt to deliberately damage betterfly.com or undermine the legitimate operation of the Contest is unlawful and subject to legal action by Bebetter LLC or its designees.

6) General: This Contest is subject to all applicable federal, state and local laws. If any prize or prize notification is returned as undeliverable, prize will be forfeited and an alternate Winner will be selected. All federal, state or other tax liabilities (including income tax) arising from this Contest will be the sole responsibility of each prize Winner.
